Copyright Compliance Policy

Policy Statement

In addition to complying with the Muhlenberg College Copyright Policy, Trexler Library adheres to a more specific policy with regard to interlibrary loan and reserves.

Purpose of the Policy

Trexler Library attempts to remain within the following guidelines:

Reserves

For electronic reserves, the library’s policy is based on, but not limited to, the American Library Association Statement on Fair Use and Electronic Reserves. Specifically:

First factor: The character of the use.

Second factor: The nature of the work to be used.

Third factor: The amount used.

Fourth factor: The effect of the use on the market for or value of the work.

The library also avails itself of the TEACH Act. Specifically,

In the course management system, a password-protected learning environment,  “the performance of a nondramatic literary or musical work or reasonable and limited portions of any other work, or display of a work in an amount comparable to that which is typically displayed in the course of a live classroom session,” is permitted.

Interlibrary Loan

With regard to interlibrary loan, the library strives to follow the CONTU Guidelines for Interlibrary Loan Photocopying .
